1. Acceptance of Terms

By accessing or using LuxCMS (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to all terms, you may not access the Service. This agreement governs your use of our AI-powered website builder, marketing tools, and CRM platform.

2. Account Responsibility

You are responsible for maintaining the security of your account and password. LuxCMS cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You are responsible for all content posted and activity that occurs under your account.

3. AI-Generated Content

Our service uses artificial intelligence to generate websites, marketing copy, and media. While we strive for high-quality output, you acknowledge that AI-generated content may occasionally be inaccurate or inappropriate. You are responsible for reviewing and approving all content before publication. LuxCMS does not claim ownership of the content you generate.

4. Payment and Subscriptions

A valid payment method is required for paid tiers (Essential and Professional). All fees are exclusive of any taxes or duties. Subscriptions are billed on a recurring monthly basis. You can cancel through the Stripe portal at any time; however, no refunds are provided for partial months of service.

5. Prohibited Use (Anti-Spam)

You may not use LuxCMS to send unsolicited messages (Spam), including SMS or Email. All marketing outreach must comply with local laws (e.g., TCPA in the US). Failure to comply with our anti-spam policy will result in immediate account termination.

6. Limitation of Liability

LuxCMS shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the service.
